The Board of Health, City of Haverhill, in accordance with and under the authority granted by Section 31 of Chapter 111 of the Massachusetts General Laws adopted the following regulations at a public hearing held on January 20, 1998 and amended at a public hearing held on August 19, 2003:
DUMPSTER REGULATIONS AND FOR THE REMOVAL AND TRANSPORTATION OF GARBAGE, RUBBISH, OFFAL OR OTHER OFFENSIVE SUBSTANCES
1. REQUIRED DUMPSTERS
All new construction sites shall be required to have a dumpster of sufficient size to contain all construction debris.
2. PLACEMENT
Each dumpster must be located at a minimum of ten feet (10') from the lot lines as to not interfere with the safety, convenience or health of abutters for residents. It must not obstruct the view of flowing traffic or be a nuisance. It must be placed on a smooth non-pervious surface in order to be easily maintained. The dumpster location must be approved by the Board of Health before placement.
3. SCREENING
When deemed necessary by the Board of Health, it may be required that dumpster sites be enclosed or screened by the property owner or authorized agent.
4. LOCKS/LIDS
Dumpsters must be locked at the end of the business day. Lids must be kept closed on all dumpsters when not in use.
5. IDENTIFICATION
The Hauler's name or company logo, telephone number, and a unique identification number and the dumpster user's name must be visible on each dumpster.
6. OVERFLOWING
Each dumpster must be of sufficient size and capacity to eliminate overflowing, and allow lids to close. It is the responsibility of the property owner to schedule the emptying frequency of the dumpster to prevent overflowing.
7. CLEANING
Dumpster must have lids, be kept clean, in good repair, free of offensive odors and all other nuisances. They must be cleaned, washed, or sanitized a minimum of two times a year (more often if so ordered by the city.) Cleaning on the street or sidewalk is not permitted.
8. LITTER FREE
It shall be the responsibility of the property owner or agent being serviced to maintain the dumpster free of odors, scattered debris, and all other nuisances.
9. GRINDABLE FOOD WASTE
Dumpsters may not be used for the disposal of grindable garbage, unless the garbage is contained in sealed plastic bags or containers.
10. EMPTYING/TIME OF DAY
The emptying of the dumpster may not commence before 7:00 a.m. in residential areas of the city, or those areas containing residential dwellings, or other areas as determined by the Board of Health or it's agents.
11. AUTHORITY
When deemed necessary by the Board of Health or its agents, it may be ordered that a dumpster be required on the premises. This determination will be based on an investigation of the average amount of refuse generated weekly at a particular site.
12. PERMITS
No contractor, firm, or person shall supply a dumpster in the City of Haverhill for the purpose of storage, removal, or transporting garbage, rubbish, offal or other offensive substances without first obtaining a dumpster permit and a waste haulers permit from the Board of Health. All permits shall expire at the end of the calendar year in which they were issued, but may be renewed annually upon application submitted to the Board of Health.
13. FEES
The fee for a dumpster permit is $25.00 dollars, renewal fee is $10.00.
14. TEMPORARY DUMPSTER PERMITS
Temporary dumpster permits may be issued to a property owner or authorized agent for a period of time not to exceed 30 days, in connection with construction, demolition, fairs, carnivals, or for other similar temporary needs. The property owner shall comply with all the provisions of these regulations which are applicable to the operation of the dumpster. The fee for a temporary dumpster is $15.00
15. EXEMPTIONS
No fees shall be collected for municipally used dumpsters.
16. PENALTIES
Permits may be revoked or suspended by the Board of Health for failure of the dumpster contractor or the property owner/his authorized agent to comply with the requirements of these regulations. Violations of these regulations shall be subject to a $75.00 fine for each offense. Each day of violation shall be considered a separate offense.
